Peach AB – Terms of Use

1. Acceptance of Terms

By using the Peach website (https://peach.nu) or associated mobile applications (the “Service”), you accept these terms of use (the “Terms”). The Terms constitute a legally binding agreement between you and Peach AB (“Peach”, “we”, “us”). If you do not accept the Terms, you should not use the Service.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

3. Personal Data and Data Sharing

When you use the Service, you consent to us sharing your personal data – including name, email address, and, if provided, phone number – with the creators from whom you book or purchase services. This is done to enable communication regarding your booking.

Creators who receive your data undertake to:

• Use the data solely for booking-related communication
• Not sell or forward the data to third parties without your consent
• Comply with applicable data protection legislation, including GDPR

Peach is not responsible for how creators handle your personal data beyond the commitments they have made to Peach.

4. Marketing Consent

By completing a booking through Peach, you consent to Peach and the creator you booked with using your email address and name for marketing purposes in digital channels, including but not limited to:

• Email and newsletters
• Meta platforms (Facebook and Instagram), including Custom Audiences and lookalike targeting
• Other digital advertising platforms

You may withdraw your consent at any time by contacting us at team@peach.nu or by clicking “unsubscribe” in any communications. Withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.

5. Intellectual Property

All content on the Service – including text, graphics, logos, icons, images, audio clips, and software – belongs to Peach or our licensors and is protected by copyright and other intellectual property rights.

6. User Account

You may need to register an account to use certain parts of the Service. You are responsible for providing accurate information and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account.

7. Creators – Rights and Obligations

Peach is a two-sided platform that provides booking and payment services for independent creators (e.g., yoga teachers, pilates instructors). Creators using Peach undertake to:

• Provide accurate and up-to-date information about their services, prices, and availability
• Fulfill all applicable tax obligations related to revenue through Peach
• Be responsible for the quality of the services they offer – Peach is not a party to the agreement between the creator and the end user
• Handle personal data received through Peach in accordance with GDPR
• Not use Peach to offer services that are illegal or violate Peach guidelines

8. Payments and Refunds

8.1 Payment Processing

Peach processes payments between end users and creators. Payment is made at the time of booking. We reserve the right to engage third-party providers for payment processing.

8.2 Cancellations and Refunds

General rules:

• Cancellation more than 24 hours before the scheduled time: full refund unless the creator specifies otherwise
• Cancellation within 24 hours: the creator decides if and how much is refunded
• No-show without cancellation: no refund

In case of refund disputes, please contact the relevant creator first, and secondarily Peach at team@peach.nu.

8.3 Peach Liability

Peach is not responsible for creators’ financial obligations towards end users. If a creator is unable to deliver their service, we refer you to contact us to investigate the possibility of a refund.

9. Prohibited Activities

You may not:

• Use the Service for unauthorized or illegal purposes
• Use automated systems (e.g., bots or scrapers) without written permission from Peach
• Disrupt servers or networks connected to the Service
• Harass, harm, or exploit other users
• Publish content that is illegal, offensive, or infringes third-party rights

10. User-Generated Content

By publishing content through the Service, you grant Peach a non-exclusive, royalty-free, worldwide, and irrevocable right to use, reproduce, adapt, distribute, and display such content in all media, for the purpose of operating and marketing the Service.

11. Disclaimer and Limitation of Liability

The Service is provided “as is”. Peach makes no warranties that the Service is free from errors or interruptions. To the extent permitted by law, Peach disclaims all liability for direct or indirect damages arising from your use of the Service.

12. Indemnification

You agree to hold Peach and its representatives harmless from claims, damages, and costs – including reasonable attorney fees – arising from your use of the Service or breach of these Terms.

13. GDPR Compliance

Peach processes personal data in accordance with GDPR. You have the right to request access to, rectification of, erasure of, or restriction of processing of your personal data, as well as the right to object to processing and the right to data portability. 14. Cookies and Tracking

Peach uses cookies and similar tracking technologies to improve the user experience and for analytical purposes. By using the Service, you consent to our use of cookies. You can manage your cookie settings through your browser.

15. Age Restriction

If you are under 18 years of age, you may only use the Service with the consent of a parent or guardian. By using the Service, you certify that you are either 18 years or older, or that you have such consent.

16. Dispute Resolution

Any disputes arising from these Terms shall primarily be resolved through direct negotiations. If the dispute cannot be resolved amicably, it may be referred to the Swedish National Board for Consumer Disputes (ARN) or settled by a Swedish court of general jurisdiction, with Stockholm District Court as the court of first instance.

17. Miscellaneous

If any provision of these Terms is found to be invalid, the remaining provisions shall continue to apply. These Terms constitute the entire agreement between you and Peach regarding your use of the Service.
